1. Use of The Mayo School Website
The Mayo School Website is provided to you free of charge for your personal use, subject to these Terms and Conditions. By using The Mayo School website you agree to be bound by these Terms and Conditions.
THESE TERMS AND CONDITIONS DO NOT AFFECT YOUR STATUTORY RIGHTS.
2. Amendments
We may update these Terms and Conditions from time to time and any changes will be notified to you via the e-mail address provided by you on registration or via a suitable announcement on The Mayo School website. The changes will apply to the use of The Mayo School website after we have given notice. If you do not wish to accept the new Terms and Conditions, you should not use The Mayo School website and the Online Shop. If you continue to use the website or Online Shop after the date on which the change comes into effect, your use of the website indicates your agreement to be bound by the new Terms and Conditions.
3. Registration
To register with The Mayo School and use the Online Shop you must agree to these terms and conditions.
You must be over 18 years of age.
You must ensure that the details provided by you on registration or at any time are correct and complete. You must inform us of any changes to the information that you provided when registering by updating your personal details.
The Mayo School may suspend or cancel your registration at our reasonable discretion or if you breach any of your obligations under these Terms and Conditions. You can cancel this agreement at any time by informing us in writing. If you do so, you must stop using The Mayo School website. The suspension or cancellation of your registration and your right to use The Mayo School website shall not affect either party’s rights or liabilities.
4. Password and Security
When you register as a student at The Mayo School you will be given a password. You must keep this password confidential and must not disclose it or share it with anyone. You will be responsible for all activities and orders that occur or are submitted under your password. If you know or suspect that someone else knows your password you should notify us (see below for contact details) immediately.
5. Limitation of liability
At all times our acceptance of an order takes place on despatch of the order, at which point the purchase contract will be made and you will be charged for your order. All offers are subject to availability. The Mayo School shall not be liable to any customer for any financial loss arising out of the refusal, cancellation or withdrawal of an order.
6. Intellectual property
The content of The Mayo School website is protected by copyright, trade marks, database and other intellectual property rights. You may retrieve and display the content of the website on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. Where the publication is purchased in hard copy format, the Customer shall not make any copies. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on The Mayo School website without written permission from The Mayo School.
7. Limitations
You may not use The Mayo School website for any of the following purposes:
- Disseminating any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material.
- Transmitting material that encourages conduct that constitutes a criminal offence, results in civil liability or otherwise breaches any relevant laws, regulations or code of practice.
- Gaining unauthorised access to other computer systems.
- Interfering with any other person’s use or enjoyment of The Mayo School website
- Breaching any laws concerning the use of public telecommunications networks
- Making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner
8. Availability of The Mayo School Website
Although The Mayo School aims to offer you the best service possible, it makes no promise that the services at the The Mayo School website will meet your requirements. If a fault occurs in the service you should report it (see below for contact details) and we will attempt to correct the fault as soon as we reasonably can. Your access to The Mayo School website may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. The Mayo School will attempt to restore the service as soon as it reasonably can.
9. The Mayo School’s Liability
The Mayo School website is provided by The Mayo School without any warranties or guarantees. You must bear the risks associated with the use of the Internet.
The Mayo School provides content from other Internet sites or resources and while The Mayo School tries to ensure that material included on The Mayo School website is correct, reputable and of high quality, it cannot accept responsibility if this is not the case. The Mayo School will not be responsible for any errors or omissions or for the results obtained from the use of such information or for any technical problems you may experience with The Mayo School website. The Mayo School is informed of any inaccuracies in the material on the Site we will attempt to correct the inaccuracies as soon as we reasonably can.
10. Third Party Websites
As a convenience to customers, The Mayo School website includes links to other websites or material which are beyond its control. The Mayo School is not responsible for content on the Internet or World Wide Web pages or any other site outside The Mayo School website.
11. Advertising and Sponsorship
Part of the The Mayo School website may contain advertising and sponsorship. Advertisers and Sponsors are responsible for ensuring that material submitted for inclusion on The Mayo School website complies with relevant laws and codes. We will not be responsible for any error or inaccuracy in advertising and sponsorship material. The Mayo school does not endorse any of the products or services advertised.
12. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and any disputes will be decided only by the English courts.
13. International Use
The Mayo School makes no promise that materials on the The Mayo School website are appropriate or available for use in locations outside the United Kingdom, and accessing The Mayo School website from territories where its contents are illegal or unlawful is prohibited. If you choose to access this site from locations outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws.
14. Online Shop
14.1 Price
The price of goods purchased shall unless otherwise expressly specified be deemed to be exclusive of all duties and taxes in respect of the Goods and/or the Services and exclusive of any export and/or import duties, all of which taxes and duties shall be for the Customer account and will be invoiced in addition.
The Mayo School reserves the right to vary the Contract Price for any Goods and/or Services supplied under the Contract if following the date of the Contract there is any change in the rates of exchange or any imposition or alteration of Government tax which increases the cost to The Mayo School of supplying the Goods and/or Services.
14.2 Bookings and Payment
Bookings made via The Mayo School website will be binding.
Our acceptance of an order takes place on despatch of the order, at which point the purchase contract will be made and you will be charged for your order.
Payment in full of all valid invoices shall be made by the Customer prior to delivery of the Goods and/or Services.
In the event that the Customer fails to make any payment on the due date to The Mayo School, The Mayo School shall be entitled to suspend any further deliveries of Goods and/or Services to the Customer without liability to The Mayo School.
Payment must be made in £ sterling only.
Acceptable methods of payment are by cheque (payable to The Mayo School), credit card or bank transfer. Bank transfers free of all charges, can be made to The Mayo School’s address located on the website. When paying by bank transfer, please quote the relevant course, reference number, and the delegate and company name. You will also need to complete a booking form and submit it to the Mayo School with your details and requirements, with a note to let us know you will be paying by bank transfer.
Students who have agreed to pay by instalments are legally bound to pay all charges and payments for which they have registered.
Students are not eligible to graduate in any course until all outstanding fees have been paid.
14.3 Expiry Date on Payment Card
Please ensure that the expiry date of your payment card is after the anticipated despatch date of your order. Payment is taken at the point of despatch for goods and in the event that the payment card has expired we will be unable to take payment and fulfil your order.
14.4 Cancellation and Refunds
Notice of cancellations for certificate, advanced certificate or diploma courses that have been ordered by hard copy must be in writing and must be accompanied by a return of any goods received in their original condition within 30 days after booking in order for the payment to be refunded. If notice of a cancellation is received after this 30 day deadline, payment will not be refunded. A 20% cancellation fee will be charged.
Cancellation from purchases of PDF delivery goods will incur an 70% cancellation charge.
Cancellation from purchases of PDF and hard copy delivery goods will incur an 80% cancellation charge.
Cancellation of online classes will need to be cancelled within 7 days of the class and will incur a 20% cancellation fee. No refunds will be given for cancellations within 7 days of the class. In the event an attendee cannot attend the class, a recorded commentary of the class will be sent to the registered participant.
14.5 Delivery
Whilst The Mayo School will endeavour to achieve any delivery dates agreed for the Goods and/or Services, all such dates are estimates only and The Mayo School shall have no liability to the Customer in the event of failure to deliver by these dates.
Delivery of Goods to the Customer will be to the delivery address as advised by the Customer. The Contract Price will include the delivery charge.
Risk in the Goods shall pass to the Customer upon delivery in accordance with the Contract.
14.6 Limitation of Liability
The Mayo School shall in no circumstances be liable for any indirect, special or consequential loss or loss of profits or business howsoever arising in connection with or arising out of the supply of Goods and/or Services even if The Mayo School shall have been advised of the possibility of such potential loss and shall not be liable for any loss except as provided herein.
The Mayo School accepts unlimited liability for death or personal injury resulting from its negligence.
14.7 Students who have arranged to pay by instalments are required to pay the full amount of the course registered at dates allocated by the Mayo School.
14.8 Unpaid fees may result in legal action.
14.9 Students who have been granted extensions beyond the course deadlines (one year for certificate students and two years for diploma students) will be required to pay £150 for six months and £300 for one year.
15. Services
Services will be provided by such Contractors as The Mayo School considers suitably qualified to undertake the work. The Mayo School also warrants that Services will be undertaken using reasonable skill and care.
16. Online Classes
To qualify for discounted rates, students must either be graduates of the certificate or diploma course or actively studying with the Mayo School.
By participating in online classes you permit the school to record and sell the lecture that they have participated in.
Participants of the online classes have no intellectual property rights from the class.
Participants acknowledge that all material viewed and heard during the classes is strictly the property rights of the Mayo School.
Only the person that has registered for the class can attend. The fee for the class is not transferable.
The Mayo School accepts no responsibility for any attendee of the class who has not got broadband.
The Mayo School accepts no responsibility for any attendee of the class who has not followed the technical instructions for access to the class.
Participants will ensure they join the class with a headset installed.
Cancellation of online classes will need to be cancelled within 7 days of the class and will incur a 20% cancellation fee. No refunds will be given for cancellations within 7 days of the class. In the event an attendee cannot attend the class, a recorded commentary of the class will be sent to the registered participant.
Participants of a class will behave appropriately at all times.
The Lecturer has the right to exclude any participant for any reason.
If a participant is excluded from the class, a full refund will be given.
The Mayo School has the right to refuse any participant from booking any class.
The programme of any class is subject to change.
17. Requirements
The certificate course must be completed in one year and the diploma course in two years. Students can apply for extensions but these are at the discretionary of the school.
Students who submit any work that has been plagiarised, or submitted any written work by another which is not referenced may have their studies terminated by the school.
18. Events
1) Cancellations for any events which have recordings available for a limited time must be made within 30 days of registering.
2) Cancellation for any events which do not have recordings available must be made within 7 days of the event.
3) Any refunds will incur a 20% cancellation fee.
4) Registering for any Mayo event, implies permissions for the Mayo school and any of its subsidiaries’ of the named event, to contact the customer for any future marketing, unless that permission has been expressly denied.
